I understand that FBI/DE is currently investigating a potential voter registration fraud scheme involving canvassers for in Michigan’s 2020 election. As part of that investigation, you have proposed conducting interviews of approximately 100 individuals who served SIN 2:5 in 2020 to determine whether those canvassers submitted falsified voter registration applications in 2020, possibly in order to meet quotas for the submission of voter registration applications as part of their employment. Michigan has an election for local offices throughout the state scheduled for November 7, 2023. As we discussed, this matter implicates the Department’s election non-interference policy, JM § 9-85.300, and its election-year sensitivities policy, JM § 9-85.500. This is because voter registration in Michigan is unitary, meaning that voter registration involves registering to vote both in federal and state elections. In addition, interviews of numerous current or former canvassers close in time to the November 7, 2023, election may create a public perception of the Department and FBI acting with a purpose of affecting the outcome of that upcoming election. Accordingly, PIN concurs in the proposed interviews of the canvassers only after the November 7, 2023, election is concluded, certified, and uncontested. We discussed conducting these potential interviews in December 2023, and PIN would concur in conducting those interviews at that time. PIN also concurs in any appropriate coordination with state and local law enforcement and election administration authorities, and any other appropriate covert investigative activity, even prior to the November 7, 2023, election. Please consult with us again prior to engaging in any other potentially overt investigative activity close in time to another election, to include Michigan’s presidential primary election on February 27, 2024, or Michigan’s state primary election on August 6, 2024. Please also consult again before bringing any charges or making any public statement regarding this matter. Please let me know if there is anything else we can do to assist.
